A Study of Jurors’ Attitudes Toward Theft of Trade Secrets Cases

Overview

DOAR recently conducted a survey that measures public attitudes toward trade secret theft and where opinions might diverge by circumstance and venue. More than 1,600 respondents completed the survey across four major intellectual property venues: the Marshall Division of the Eastern District of Texas, the Waco Division of the Western District of Texas, the Central District of California, and the District of Delaware.

We asked respondents sets of questions about two types of conduct often associated with trade secret theft:

  1. An employee taking an employer’s confidential or proprietary materials and information
  2. An employee giving that information to a new employer

    Results from the study reveal how potential jurors view the retention and sharing of confidential and technical information, with implications for both litigation strategy and corporate policy.
