Judge Rejects FTC’s Bid to Block Tempur Sealy’s $4B Purchase of Mattress Firm

Congratulations to the trial teams at Cleary Gottlieb Steen & Hamilton, Simpson Thacher, and Beck Redden on securing a favorable decision for their clients Tempur Sealy and Mattress Firm Group Inc. The antitrust matter concerned the FTC’s motion for a preliminary injunction to block the closing of Tempur Sealy’s planned purchase of Mattress Firm, alleging that the merger would inhibit competition.

U.S. District Judge Charles Eskridge for the Southern District of Texas rejected the FTC’s claims and instead expressed that the merger would likely have a neutral or pro-competitive effect, like most other vertical mergers of this type.
